VERDICT AND SETTLEMENT INFORMATION
Lawyers in litigation need to be able to ascertain what amount they can reasonably expect to recover in damages on particular types of claims. This is necessary in order to help the client and the attorney make decisions on the advisability of litigating and on reasonable settlement results, and to support claims for verdict reduction where awards are excessive.
The need for this information can be met by services that gather and publish information about verdict and settlement amounts by the type of action in particular courts. These reports usually contain summaries of the facts of the situations and the holdings on the various claims. The reports can be useful sources of information on how trial courts in a jurisdiction are handling various types of claims and can also provide the names of expert witnesses. Note that trial decisions are rarely published.
